Well Call of Juarez is a DX10 game and it uses Shader model 4 and I have Vista and an 8800 AND I played the game, so I guess thats proof enough? :P
yep the GPU has both SM3.0 and SM4.0 built into it. For Vista it ofcourse uses SM4.0 and for XP it uses SM3.0. Vista can do all Dx9 features (SM3.0) and then the Dx10 features too.
